WISME PRIVACY POLICY

Confyday Inc. ("Confyday," "we," "us," or "our") operates the Wisme mobile application, website, and related services (collectively, the "Service"). This Privacy Policy describes how we collect, use, disclose, store, and protect information about you when you use the Service.

By accessing or using the Service, you agree to this Privacy Policy. If you do not agree with this Privacy Policy, you may not use the Service.

SCOPE OF THIS PRIVACY POLICY

Application. This Privacy Policy applies to all users of the Service, including users who maintain private content, users who engage in social and community features, and users who operate as creators, mentors, or monetize their presence on the Service ("Creators").

Types of Content. The Service allows users to create and share different types of content with varying levels of visibility:

  • Private Content: Content you create for your personal use, such as private journal entries, goals, habits, reflections, and mood tracking data, which is not visible to other users unless you choose to share it.
  • Shared Content: Content you share with specific users or groups, such as messages, posts in private community spaces, or content shared with followers.
  • Public Content: Content you make publicly available, such as Creator profiles, public posts, and content accessible to all users or non-users of the Service.

Children's Privacy. The Service is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will take steps to delete such information as soon as possible. INFORMATION WE COLLECT

We collect information about you in several ways when you use the Service.

Information You Provide Directly

Account and Profile Information. When you create an account, you provide information such as your name, email address, username, password, profile picture, bio, interests, and other profile details.

Goals, Habits, and Planning Data. When you use productivity features, you provide information such as goals you set, habits you track, routines you build, schedules you create, and tasks you plan.

Journals, Reflections, and Mood Data. When you use journaling and reflection features, you provide written entries, responses to prompts, mood tracking data, and other personal notes.

Social Interactions. When you engage with social and community features, you provide messages, comments, posts, reactions, and other content you share with other users or in community spaces.

Creator Content and Monetization Data. If you are a Creator, you provide content you publish (such as posts, videos, images, and insights), information about your audience and engagement, and information related to monetization activities such as subscriptions, donations, and products you offer.

Payment and Financial Information. If you make purchases or monetize your presence on the Service, you provide payment information to third-party payment processors. We do not directly collect or store full credit card numbers but may receive limited payment information such as the last four digits of your card, billing address, and transaction history.

Communications with Us. When you contact us for support or other purposes, you provide the contents of your messages, including any attachments, as well as your contact information.

Surveys and Research. If you participate in surveys, studies, or research activities, you provide the information you submit in connection with those activities.

AI Interaction Data

When you interact with AI-powered features of the Service, we collect:

  • Inputs and Prompts: The text, questions, commands, or other data you input into AI-powered features;
  • AI Outputs: The content, suggestions, recommendations, and responses generated by AI systems in response to your inputs;
  • Interaction Metadata: Timestamps, frequency of use, session duration, feature usage patterns, and other technical data related to your AI interactions;
  • Feedback: Any feedback you provide regarding AI Outputs, such as ratings, corrections, or reports.

Information Collected Automatically

Device Information. We collect information about the devices you use to access the Service, including device type, operating system and version, device identifiers (such as IDFA, Android ID, or other unique identifiers), browser type and version, screen resolution, and mobile network information.

Usage Information. We collect information about how you use the Service, including the features you use, the actions you take, the content you view or interact with, the time and duration of your activities, search queries, and navigation paths.

Log Data. Our servers automatically record information when you use the Service, including IP address, access times, pages viewed, links clicked, crashes, errors, and the page you visited before navigating to the Service.

Location Information. We may collect approximate location information based on your IP address. If you grant us permission through your device settings, we may collect precise geolocation data.

Cookies and Similar Technologies. We and our service providers use cookies, web beacons, pixels, local storage, and similar tracking technologies to collect information, recognize you across devices and sessions, remember your preferences, authenticate your account, analyze usage, and deliver personalized content and advertising. Information from Third Parties

Third-Party Account Integrations. Other Users. Other users may provide information about you, such as when they tag you in content, refer you to the Service, or report your content or conduct.

Providing and Operating the Service

  • To enable you to use the features and functionality of the Service;

This includes supervised and unsupervised learning, model fine-tuning, reinforcement learning, and other machine learning techniques.
  • Evaluate AI Performance: We analyze AI Outputs and user feedback to assess accuracy, relevance, safety, and quality of AI-generated content.
  • Enhance Personalization: We use AI to analyze your usage patterns, preferences, and content to deliver personalized recommendations, suggestions, and experiences.
  • Safety and Quality Assurance: We use AI to detect harmful, inappropriate, misleading, or low-quality content and to improve trust and safety systems.

Automated Processing at Scale: Training and improvement of AI systems may occur through automated processes that analyze large volumes of data. AI Outputs may resemble existing content or patterns without any intent to replicate specific user contributions.

De-Identification and Aggregation: Where feasible and appropriate, we de-identify or aggregate data used for AI training to reduce the association between data and individual users. However, some AI training may involve identifiable data where necessary for functionality, personalization, or safety.

Trust, Safety, and Enforcement

  • To enforce our Terms of Use and other policies;
  • To detect, prevent, and respond to fraud, abuse, security threats, illegal activity, and violations of our policies;
  • To moderate content and conduct, including reviewing reported content or conduct;
  • To protect the rights, property, and safety of Confyday, our users, and the public.

Legal, Compliance, and Business Operations

  • To comply with legal obligations, court orders, subpoenas, and government requests;
  • To establish, exercise, or defend legal claims;
  • To protect our rights and interests;
  • To facilitate corporate transactions such as mergers, acquisitions, asset sales, or bankruptcy proceedings;
  • To manage business operations, accounting, auditing, and recordkeeping.

Marketing and Communications

  • To send you promotional communications, updates, newsletters, and information about the Service, features, events, or offers (you may opt out of marketing communications at any time);
  • To display advertisements, including personalized advertising based on your interests and activity.

Other Purposes

For any other purpose disclosed to you at the time we collect information or with your consent.

HOW WE SHARE INFORMATION

We share information in the following circumstances:

With Other Users

Shared and Public Content. Content you share with other users or make publicly available (such as posts, comments, Creator content, profile information, or activity in community spaces) is visible to those users or the public, as applicable.

Social and Community Features. When you interact with other users through social and community features, they may see your username, profile information, and the content of your interactions.

Creator-Follower Relationships. If you follow a Creator or subscribe to their offerings, the Creator may see information about your engagement with their content, such as views, likes, comments, or subscription status.

Service Providers and Business Partners

We share information with third-party service providers, contractors, and partners who perform services on our behalf, including:

  • Cloud hosting and infrastructure providers;
  • Payment processors and financial service providers;
  • Analytics and data analysis providers;
  • Customer support and communication tools;
  • Marketing, advertising, and attribution services;
  • Security and fraud prevention services;
  • AI and machine learning service providers.

These service providers are contractually obligated to use your information only as necessary to provide services to us and are required to maintain appropriate security measures.

Advertising and Analytics Partners

With Your Consent

We may share information with third parties when you direct us to do so or consent to such sharing, such as when you connect third-party integrations or participate in co-branded offerings.

Aggregated and De-Identified Information

We may share aggregated, anonymized, or de-identified information that cannot reasonably be used to identify you. Such information is not subject to this Privacy Policy.

DATA RETENTION

Retention Periods. We retain your information for as long as necessary to provide the Service, fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, and enforce our agreements.

Criteria for Retention. Retention periods are determined based on:

  • The nature and sensitivity of the information;
  • The purposes for which we collected and use the information;
  • Legal, regulatory, tax, accounting, or reporting requirements;
  • Security, fraud prevention, and safety considerations;
  • Whether you have requested deletion of your information.

Deletion Requests. If you request deletion of your account or information, we will take reasonable steps to delete your information, subject to the exceptions described below. Deletion may not be immediate and may require time to complete across our systems and backups.

Limitations on Deletion. We may retain certain information even after you request deletion if necessary to:

  • Comply with legal obligations (such as tax, financial reporting, or record-keeping requirements);
  • Detect, prevent, or investigate fraud, abuse, security incidents, or violations of our Terms of Use;
  • Resolve disputes or enforce our agreements;

  • Protect the rights, property, or safety of Confyday, our users, or the public.

AI Training Data. Information used to train AI models may be retained indefinitely in de-identified, aggregated, or model-embedded form, even after you delete your account. Once data has been incorporated into AI models, it may not be feasible to remove specific contributions.

YOUR RIGHTS AND CHOICES

Access and Correction

You may access and update certain account information and profile details through your account settings. If you are unable to access or correct information through the Service, you may contact us at info@confyday.com.

Account Deletion

You may request deletion of your account at any time by following the account deletion process in the Service or by contacting us at info@confyday.com. Upon deletion, we will take reasonable steps to delete your information, subject to the retention limitations described in Section 5.

Privacy Settings

The Service provides privacy settings that allow you to control the visibility of your content and profile information. You can manage these settings through your account preferences.

Marketing Communications

You may opt out of receiving promotional emails from us by following the unsubscribe instructions in those emails or by adjusting your notification preferences in your account settings. Even if you opt out of marketing communications, we may still send you non-promotional messages related to your account or transactions.

Cookies and Tracking

You can manage cookies and tracking technologies through your browser settings or device settings. Most browsers allow you to block or delete cookies. However, disabling cookies may affect your ability to use certain features of the Service.

Authorized Agents: You may designate an authorized agent to make requests on your behalf. We require written authorization from you or proof of power of attorney before processing requests from authorized agents.

European Economic Area, United Kingdom, and Switzerland. If you are located in the EEA, UK, or Switzerland, you have rights under the General Data Protection Regulation (GDPR) and equivalent laws, including rights to access, rectify, erase, restrict processing, object to processing, and data portability. Limits on Your Rights

Your rights are subject to certain limitations under applicable law. For example, we may deny requests that are manifestly unfounded, excessive, or repetitive, or where disclosure would adversely affect the rights of others, violate legal obligations, or compromise security or integrity of the Service.

SECURITY

Security Measures. We implement reasonable technical, administrative, and organizational security measures designed to protect your information from unauthorized access, disclosure, alteration, and destruction. These measures include encryption, access controls, secure coding practices, regular security assessments, and employee training.

End-to-End Encryption. Certain types of User Content, such as private messages and journal entries, may be protected by end-to-end encryption, meaning that such content is encrypted on your device and can only be decrypted by the intended recipient or by you. We cannot access the contents of end-to-end encrypted content. However, metadata (such as sender, recipient, timestamp, and message length) is not encrypted and may be accessible to us.

No Guarantee of Security. Despite our security measures, no method of transmission over the Internet or method of electronic storage is completely secure. We cannot guarantee the absolute security of your information. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

Security Incidents. If we become aware of a security incident that compromises your personal information, we will notify you and relevant authorities as required by applicable law.

INTERNATIONAL DATA TRANSFERS

Global Operations. Confyday is based in the United States, and the Service is hosted on servers located in the United States and other countries. If you access the Service from outside the United States, your information will be transferred to, stored, and processed in the United States and other jurisdictions where our service providers operate.

Data Protection Standards. The United States and other jurisdictions may have data protection laws that differ from the laws of your country. When we transfer information internationally, we implement appropriate safeguards, such as standard contractual clauses, to protect your information in accordance with applicable law.

Consent to Transfer. By using the Service, you consent to the transfer, storage, and processing of your information in the United States and other countries.

THIRD-PARTY SERVICES AND LINKS

Third-Party Services. The Service may integrate with or link to third-party websites, applications, or services that are not operated or controlled by Confyday. This Privacy Policy does not apply to third-party services. We are not responsible for the privacy practices of third parties.

Third-Party Data Collection. Third-party services may collect information about you independently. We encourage you to review the privacy policies of any third-party services you use.

DO NOT TRACK SIGNALS

Some browsers transmit "Do Not Track" (DNT) signals. We do not currently respond to DNT signals because there is no industry consensus on how to interpret or respond to such signals. We will continue to monitor developments related to DNT and may implement responses in the future.

CHANGES TO THIS PRIVACY POLICY

Right to Modify. We may update this Privacy Policy from time to time to reflect changes in our practices, the Service, legal requirements, or other factors. When we make material changes, we will notify you by posting the updated Privacy Policy on the Service and updating the "Effective Date" above.

Notice of Material Changes. For material changes, we may provide additional notice, such as by email or by displaying a prominent notice within the Service.

Continued Use. Your continued use of the Service after the updated Privacy Policy becomes effective constitutes your acceptance of the changes. If you do not agree to the updated Privacy Policy, you must stop using the Service.
